Can I get a Form-16 without TDS?

Yes, you can get Form 16 from your employer without TDS.

In such cases, you will receive Form 16 Part B.

Form 16 has 2 parts:

  • Part A: is a certificate of TDS, it contains details of TDS deducted by your employer
  • Part B: it is an annexure with details of Income Chargeable under the head of Salary. It contains details of bonus, allowances, perquisites, etc. that you receive from the employer during the year.

If your salary from the employer is less than the basic exemption limit i.e. INR 2.5 Lakh in a financial year, the employer is not liable to deduct TDS. However, you can file a NIL income tax return.

However, if your income from all sources (salary, house property, interest, etc.) earned during the financial year is more the basic exemption, you are required to pay tax.
