Regarding Form-10IEA

Hi,

Is there any way to file or revise the Form-10IEA wrongly filed for any FY after the due date of filing the ITR is over?

In one of the cases pertaining to AY: 2025-26, a person inadvertently opted out of new regime by filing Form-10IEA, however, filed ITR in new regime. During processing, the regime was considered as OLD (due to 10IEA) and the refund which was arising in ITR got converted into demand.

Please suggest what can be done in this case now. Is there any provision to get condonation, etc.?

No, there is currently no provision to revise or withdraw Form 10-IEA after the due date of filing the ITR. Since Form 10-IEA opted out of the new tax regime, CPC has correctly processed the return under the old regime. Rectification under Section 154 is generally not applicable. The taxpayer may submit a grievance or representation to the jurisdictional AO seeking relief, but there is no statutory provision for condonation in such cases, so relief is discretionary.
